Terms and conditions for the Canine Critic Prize Draw (the “Prize Draw”)


When entering the Prize Draw, you agree to be bound by these terms and conditions (these “Terms and Conditions”). Promotional materials relating to the Prize Draw, including all information about how to enter the Prize Draw, also form part of these Terms and Conditions. In the event of a conflict between any terms referred to in such promotion materials and these Terms and Conditions, these Terms and Conditions take precedence.


1. The promoter of this Prize Draw is Hotels.com, a Texas-based limited partnership having its registered office at 5400 LBJ Freeway, Suite 500, Dallas, TX 75240, USA (“Hotels.com”).


2. Participants must be at least 18 years old and legally resident within the USA, United Kingdom, France, Spain, Norway, Finland, Germany, Turkey, Canada (excluding Quebec), Brazil, Mexico, and Argentina and have an Instagram account. Employees and agents of Hotels.com or any of its subsidiary or affiliated companies and their immediate families and members of their households, and anyone otherwise connected with operation or fulfillment of the Prize Draw are not eligible to take part. Hotels.com reserves the right to require participants to prove that they are eligible to enter the Prize Draw. If the winner is found to be ineligible, Hotels.com reserves the right to award the prize to another participant and to require the return of any prize already awarded.


3. The Prize Draw commences at 00:00 UK time on Monday, August 12, 2019 (18.00 Central Time USA on Sunday August 11, 01:00 Central European Summer Time and 20:00 Brazil time and Argentina time on Sunday, August 11, 2019 and 18:00 Mexico time on Sunday, August 11, 2019), and all entries must be received by 23:59 UK time on the closing date of Sunday, August 25, 2019. (19:59 Brazil time and Argentina time on Saturday, August 24, 2019 and 17:59 Mexico time on Saturday, August 24 2019)


4. Entry to the Prize Draw is free; no purchase is necessary. To enter the Prize Draw, participants must follow @hotelsdotcom on Instagram, upload a picture or video of their dog on Instagram using their personal Instagram account, and tag @hotelsdotcom within the caption or picture, using the hashtag #CanineCritic in the caption. Participants may also include a short reason within the caption as to why their dog should be the next Hotels.com Canine Critic. A participant’s Instagram profile must be public in order to enter. By submitting a photo or video, participant represents, participant owns, or has permission to use the photo or video, and use by Hotels.com will not violate or infringe upon anyone’s rights, including, but not limited to, copyright, trademark, or publicity rights. Participant shall also ensure that the photo or video does not (a) prominently feature any third-party trademarks or logos; (b) portray Hotels.com or its services in a negative light; or (c) contain any content that is inappropriate or indecent, as determined by Hotels.com, at its sole discretion. If the picture depicts any person other than yourself and your dog, you must obtain written permission from each person (or from his/her parent or legal guardian) prior to submission. Entries submitted by any other means will not be accepted: only those submitted via the official method of entry will be accepted.


5. The Prize Draw will be promoted on Instagram at the following URL address: https://www.instagram.com/hotelsdotcom/ (the “Website”). Use of scripts, macros, or any automated system to enter the Prize Draw is prohibited and entries made (or that appear to have been made) using any such system may be treated as void. Any illegible, incomplete, or fraudulent entries will be rejected. Participants can enter as many times as they like but there is only one prize to be won by a single winner legally resident in one of the jurisdictions outlined in clause 2 above.


6. The prize to be won for one winner is 10 separate hotel vouchers each worth up to $200 USD (for residents of the US)/€177 (for residents of the EU)/£159 (for residents of the UK)/$200 CAD (for residents of Canada)/8,763 ARS (for residents of Argentina)/758 BRL (for residents of Brazil)/3,815 MXN (for residents of Mexico)/1.706 NOK (for residents of Norway)/1,028TRY (for residents of Turkey) each (the vouchers will have a total value of up to $2,000/€1,775/£1,592/87,630ARS/7,580BRL/38,150MXN/17,060NOK/10,280TRY) for the winner to redeem against the cost of a one-night stay in 10 separate pet-friendly hotels of the winner’s choosing from any of the eligible pet-friendly hotels listed on the Hotels.com website. If the cost of the hotel exceeds the value of the prize, then the winner is liable to pay for the remainder of the balance, and if the cost of the hotel is less than the value of the prize, the winner shall not receive any credit in respect of the difference. The winner will be provided with 10 voucher codes to be redeemed within 12 months of the date of issue by entering the code at the checkout on the Hotels.com website. Stays booked using the voucher codes will not contribute towards any Reward Night offered by Hotels.com. The prize cannot be applied to the cost of any previously purchased reservations, local taxes, or other miscellaneous charges. The winner is responsible for paying all associated costs that are not specifically stated in these Terms and Conditions, including (where applicable) transportation to and from the departure airport, the outstanding cost of the accommodation once the prize has been redeemed, meal costs, spending money, insurance (including pet insurance), and all other incidentals. The winner and anyone accompanying them are responsible for obtaining valid passports (including veterinary health certificates and pet passports) and visas and, where appropriate, obtaining appropriate vaccinations (including dog vaccinations) and inoculations for foreign travel and micro-chipping of your dog. The winner is also personally responsible for any personal or incidental expenses and any sales tax and national and/or local tax liabilities incurred in claiming or using the prize. If a minor is accompanying the winner, then that minor must be accompanied by his or her parent or legal guardian (at their own expense) if they are not the winner. The prize is as stated and is non-exchangeable and non-transferable. There is no cash or other alternative to the prize in whole or in part. By participating in the Prize Draw, participants agree that the prize is awarded on an “as is” basis, and that neither Hotels.com nor any of its subsidiary or affiliated companies, make any representations or warranties of any nature with respect to the prize. The prize is subject to the terms and conditions of Hotels.com, which can be found on the website that you use to make the booking and the voucher terms and conditions which can be found at:

7. The winner of the Prize Draw will be the first name chosen at random from all complete, eligible, properly submitted entries received before the end of the applicable closing date.


8. The winner will be notified no later than Wednesday, September 18, 2019 via a private message sent from the Hotels.com Instagram account (@hotelsdotcom) to the Instagram platform account that was used to enter the Prize Draw, and Hotels.com will obtain the winner’s email address in order to email the winner their prize. The winner may be required to submit valid identification before receiving their prize. The prize will be sent in the form of 10 separate voucher codes sent to the winner by email from Hotels.com within 14 days of the winner accepting the prize. If any emails or social media messages sent to the winner are returned as undeliverable, or if the winner does not respond to the direct message on Instagram within 48 hours, we will select another winner. Hotels.com reserves the right to conduct a further random draw to award their prize to another participant. If the winner is a Turkish or Canadian resident, he/she must correctly answer a mathematical skill-testing question in order to win the prize. If the winner has not claimed their prize by the date specified in the Instagram private message notifying them of their win, or if a Turkish or Canadian winner fails to correctly answer the skill-testing question, Hotels.com reserves the right to conduct a further random draw to award the prize to another participant.


9. In the event that, for reasons beyond Hotels.com’s reasonable control and not related to the winner, Hotels.com is unable to award the prize as described in these Terms and Conditions, Hotels.com reserves the right to award a prize of a similar nature and an equivalent value, or, at its sole discretion, the cash value of the prize.


10. By entering the Prize Draw, participants agree to have their name and photograph as the winner made available on the Website, or on Facebook, Instagram, or Twitter between September 2019 and September 2020. Details of the winner will also be made available to participants and the public on request by sending a direct message to the Hotels.com Instagram account no later than Wednesday, September 25, 2019.


11. Although the Prize Draw may be featured on Instagram, Facebook, and Twitter, the Prize Draw is in no way sponsored, endorsed, administered by, or associated with Facebook, Instagram, or Twitter, and you agree that Instagram, Facebook, and Twitter are not liable in any way. You are providing information to Hotels.com and not to Instagram, Facebook, and Twitter. The information that you provide will only be used for the purposes referred to in clause 13 below.


12. Hotels.com will collect, store, and otherwise process participants’ personal information as part of the Prize Draw in accordance with our privacy policy posted on the Hotels.com website (see https://www.hotels.com/hotel-deals/privacy/?pos=HCOM_US&locale=en_US) and will share such information with Hotels.com’s agents and affiliates (including those outside of the European Economic Area) to the extent necessary in order to conduct the Prize Draw including for the prize to be delivered to the winner. If participants do not provide any of the mandatory information requested when entering and taking part in the Prize Draw, they may not take part in the Prize Draw.


13. Hotels.com reserves the right to reasonably modify, cancel, terminate, or suspend the Prize Draw in whole or in part, at any time, considering the reasonable interest of all parties, if it believes that the Prize Draw is not capable of being conducted as specified within these Terms and Conditions or in the event of a virus, computer bug, or unauthorized human intervention, or any other cause that is beyond the reasonable control of Hotels.com that could corrupt or affect the administration, security, impartiality, or normal course of the Prize Draw. Neither Hotels.com nor any of its subsidiary or affiliated companies are responsible for any condition, circumstances, losses, failures, or delays caused by events beyond its or their control.


14. Save where it has been negligent, Hotels.com will not be responsible for any damage, loss, or injury resulting from participants’ entry into the Prize Draw or their acceptance and/or use of the prize, or for technical, hardware, or software failures, lost, faulty, or unavailable network connections, or difficulties of any kind that may limit or prohibit their ability to participate in the Prize Draw. Save where it has been negligent, Hotels.com will not be responsible for any lost, damaged, defaced, incomplete, illegible, or otherwise unreadable entries. Proof of posting is not proof of receipt by Hotels.com of any entries. Nothing in these Terms and Conditions shall in any way limit Hotels.com’s liability for death or personal injury caused by its negligence or for intent.


15. Any participant who enters or attempts to enter the Prize Draw in a manner that based on a reasonable determination is contrary to these Terms and Conditions or by its nature is unjust to other entrants (including without limitation tampering with the operation of the Prize Draw, cheating, hacking, deception, or any other unfair playing practices such as intending to annoy, abuse, threaten, or harass any other entrants or Hotels.com, and/or any of its agents or representatives) may be rejected from the Prize Draw at Hotels.com’s sole discretion. Furthermore, where such actions have significantly impaired the Prize Draw, Hotels.com may, at its sole discretion, add further stages to the Prize Draw as it deems reasonably necessary in order to resolve any problems arising as a result of such actions.


16. All Hotels.com’s decisions in relation to the Prize Draw are final, and Hotels.com will not enter into any correspondence with participants.


17. For residents of the UK, these Terms and Conditions are governed by English law. However, if you are resident of any other country, you will benefit from mandatory consumer provisions and legal rights available to you under the laws of that country. Nothing in these Terms and Conditions affects your rights to rely on those local law mandatory consumer provisions and legal rights.


18. For residents of the United States, these Terms and Conditions are governed by the laws of Texas, USA. The courts of Dallas, TX shall have exclusive jurisdiction to hear any dispute or claim arising in association with the Prize Draw or these Terms and Conditions. Participants agree that any dispute or claim shall be resolved individually, without resort to any form of class action.
